SourceQuote Terms of Service

Applies to: sourcequote.org, owned and operated by Benjamin Leavitt (the license holder). SourceQuote is open-source software. These Terms are not valid for any other deployment of this codebase. Third-party deployments are solely responsible for establishing their own terms.

Acceptance of Terms

By accessing or using SourceQuote ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

The Service

SourceQuote is a web-based transcription viewer and editor that allows users to upload audio files, generate speaker-diarized transcripts, and edit and share transcription projects. The Service is provided "as-is" (see Disclaimer of Warranties).

Eligibility

You must comply with all applicable laws in your jurisdiction to use the Service. If you are under the age of 13, you may not create an account or use the Service, in compliance with the Children's Online Privacy Protection Act (COPPA). By creating an account, you represent that you meet these requirements.

Acceptable Use

You agree not to use the Service to:

  • Upload or process content that is illegal, harmful, threatening, abusive, defamatory, or infringes any third-party rights
  • Circumvent, disable, or otherwise interfere with security features of the Service
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use the Service for any purpose that violates applicable law
  • Reverse engineer, decompile, or otherwise attempt to extract source code from the Service (beyond what is already publicly available in the repository)
  • Use automated means to scrape, crawl, or harvest data from the Service without prior written permission

We reserve the right to suspend or terminate accounts that violate these restrictions without notice.

Intellectual Property

Our content

The SourceQuote application, including its source code, design, trademarks, and documentation, is the property of Benjamin Leavitt and is licensed under the terms of the project license (see /license). These Terms do not grant you any rights in our intellectual property beyond what is expressly permitted by that license.

Your content

You retain full ownership of all audio files, transcripts, and other content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to store, process, and transmit it solely for the purpose of providing the Service to you.

We do not use your User Content for any other purpose — including model training, analytics, or commercial use.

Payments and Subscriptions

Subscription payments and one-time donations are processed by Stripe, Inc. By initiating a payment, you also agree to Stripe's Terms of Service.

Subscriptions

Subscriptions are billed on a recurring basis (monthly or yearly) at the rate displayed at the time of purchase. You may cancel your subscription at any time via the billing portal in your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time unless required by applicable law.

Failed payments

If a payment fails, we will attempt to notify you by email. Your account will be downgraded to the free tier after a grace period of 30 days following the failed payment. Your data is retained during the grace period.

Refunds

Refund requests are handled on a case-by-case basis. To request a refund, contact us at vtleavs@gmail.com.

Donations

One-time donations are voluntary and non-refundable. Donations do not grant access to any additional features or tiers.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or available at any particular time
  • Transcription output will be accurate or complete
  • The Service will meet your specific requirements
  • Any errors or defects will be corrected

Limitation of Liability

To the fullest extent permitted by applicable law, Benjamin Leavitt and SourceQuote shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, or loss of business, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) $10 USD.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

You may deactivate your account at any time from your account settings. To request permanent deletion, contact us at vtleavs@gmail.com. See the Privacy Policy for details on what happens to your data upon deactivation or deletion.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this document. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
